CBD Supplier for ACO REACH Programs: Complete Compliance Documentation Included
Your ACO REACH organization can now provide up to $500 per year in qualifying oral CBD products to eligible Medicare patients. We're set up to be your supplier, with compliant products, complete documentation, and support for your CMS implementation plan submission.
What Is ACO REACH?
ACO REACH (Accountable Care Organization Realizing Equity, Access, and Community Health) is a CMS Innovation Center model in which physician organizations take on accountability for the total cost and quality of care for their attributed Medicare patients. Organizations earn shared savings when they deliver high-quality care efficiently. The Substance Access BEI is one of several supplemental benefits ACO REACH organizations can now elect to offer to eligible patients.
How the CBD Benefit Works Within ACO REACH
Your organization elects the benefit by including it in your program participation agreement with CMS. You then submit an implementation plan describing which products you'll use, dosing protocols, how you'll determine patient eligibility, and your distribution and safeguard processes. CMS approves the plan. You order wholesale from a compliant supplier. Your physicians distribute products directly to eligible patients. The organization absorbs the product cost through the program structure.
What CMS Requires in Your Implementation Plan
- Specific products you'll provide (name, format, CBD and THC content per serving)
- How products will be distributed to patients (at appointments, by mail, etc.)
- Beneficiary eligibility criteria your physicians will use
- How you'll ensure compliance with state hemp laws
- Safeguards to prevent diversion or misuse
- Supplier documentation confirming product compliance
We provide sample language for each of these sections as part of our documentation package. See our full implementation plan guide for step-by-step assistance.

Questions from ACO REACH Administrators
What exactly is ACO REACH?
ACO REACH stands for Accountable Care Organization Realizing Equity, Access, and Community Health. It's a CMS Innovation Center model in which physician organizations take on accountability for the total cost and quality of care for their Medicare patients. Organizations in ACO REACH can earn shared savings when they keep care quality high and costs manageable. The CBD benefit is one of several supplemental benefits ACO REACH organizations can now offer.
How does our ACO REACH organization elect the CBD benefit?
Your organization's program administrator works with your CMS program contact to elect the Substance Access BEI benefit within your ACO REACH participation agreement. This involves submitting an implementation plan to CMS describing your product selection, dosing protocols, patient eligibility criteria, and safeguards. CMS must approve the plan before any products can be distributed. We provide sample implementation plan language to help your team prepare the submission.
What products can we include in our ACO REACH implementation plan?
Any oral CBD products meeting the full compliance requirements can be included: less than 0.3% delta-9 THC, less than 3mg total THC per serving, third-party lab tested, Farm Bill compliant, and from a traceable source. We recommend including our gummies and tinctures as they cover the widest range of patient preferences and administration needs.
How do we document product distribution for CMS recordkeeping?
Your organization maintains records of which patients received products, what products were provided, when they were provided, and the total value distributed. We provide batch-specific COAs and product documentation that support your recordkeeping requirements. Talk to your CMS program contact for the specific recordkeeping format they require.
Can you provide a reference letter for our implementation plan?
Yes. We can provide a supplier reference letter confirming our product compliance, USDA Organic status, and ability to fulfill wholesale orders reliably. Contact us through our wholesale inquiry form to request this letter as part of your documentation package.
