Medicare CBD Program Launches April 1: CMS Publishes Full Guidelines
CMS has published full guidelines for the Substance Access Beneficiary Engagement Incentive (BEI) program, which officially launches April 1, 2026. Here's what the guidelines cover:
The $500 annual benefit: Eligible patients can receive up to $500 worth of qualifying oral CBD products per year through their physician's organization at no cost. The benefit is not a reimbursement, it's a direct supply model in which the physician's organization provides products to patients.
Three eligible organization types: The benefit is available through ACO REACH (Accountable Care Organization Realizing Equity, Access, and Community Health), the Enhancing Oncology Model, and the LEAD (Long-term Enhanced ACO Design) Model. ACO REACH and Enhancing Oncology Model participation begins April 1, 2026. LEAD Model participation begins January 1, 2027.
Oral-only product requirement: CMS confirmed that only oral CBD products qualify. Gummies, tinctures, capsules, and oral solutions are eligible. All smoked and inhaled products, including flower, pre-rolls, and vapes, are explicitly excluded.
THC limits: Products must contain less than 0.3% delta-9 THC by dry weight and less than 3mg total THC per serving. Total THC includes all THC variants, not just delta-9.
Physician-direct supply model: Products are provided directly by the physician's organization. Patients cannot purchase CBD at retail and submit for reimbursement. There is no pharmacy claim process.
State law compliance required: Products must comply with the laws of the state where they're provided. Idaho's zero-THC requirement is the most significant state law conflict currently known.
CMS implementation plan approval required: Organizations must submit and receive CMS approval for an implementation plan before distributing any products to patients. The plan must include specific products, dosing protocols, eligibility criteria, and safeguard descriptions.
Note: the BEI program is not exclusive to any single brand — any compliant oral CBD product qualifies equally.
CMS Administrator Oz's public statements: CMS Administrator Dr. Mehmet Oz cited chronic pain management and cancer patient care as primary motivations for the program at the announcement. He described it as expanding access to a wellness tool that many Americans are already using.
